Vioxx Deal Holds Up Even After Appeals Wins: Experts

Law360, New York (May 30, 2008, 12:00 AM ET) -- Merck & Co Inc. crafted its $4.85 billion Vioxx settlement despite winning 12 of 17 jury verdicts over the painkiller. Although appeals courts have recently overturned two of those verdicts, lowered damages in a third case and rejected medical monitoring claims in still another, many legal pundits agree with Merck that settling before the appellate rulings was ultimately the right decision.
