Supreme Court Nixes Calif. Ban On Violent Video Games

Law360, New York (June 27, 2011, 2:42 PM ET) -- The U.S. Supreme Court on Monday rejected a California ban on selling violent video games to minors, ruling the controversial law violates the First Amendment because it restricts free expression without a valid justification.

California's 2005 ban sought to create a new category of unprotected speech in a mistaken bid to shoehorn speech about violence into the category of obscenity, Justice Antonin Scalia wrote for the majority, joined by four justices. Two others filed a concurring opinion, while two justices dissented.
