Law360, New York (January 26, 2012, 6:52 PM ET) -- Photographer Patrick Cariou urged the Second Circuit on Wednesday to uphold a ruling that appropriation artist Richard Prince had violated his copyright, arguing fair use did not apply because Prince had used his photographs in new works without justification.
The dispute, which is being closely watched in the art world, stems from Prince's artwork series “Canal Zone.” The series included 29 paintings, 28 of which included collaged, enlarged, cropped, tinted or over-painted images taken from Cariou's book of photographs “Yes, Rasta,” according to court papers....
