Law360, New York (February 03, 2012, 5:30 PM ET) -- The Federal Trade Commission on Friday failed to get an Ohio federal court to appoint a monitor to make sure ProMedica Health System Inc. does not consolidate its operations with St. Luke's hospital while the agency finalizes its ruling that the proposed merger violates antitrust laws.
The agency had asked for the appointment after FTC Administrative Law Judge D. Michael Chappell ruled in December that ProMedica's acquisition of St. Luke's Hospital violated the Clayton Act and told the group to sell St. Luke's to an FTC-approved buyer....
