Merger Puts Travelers On Hook For Popcorn Lung Suits: Court

Law360, New York (June 29, 2012, 5:26 PM ET) -- A New York state appeals court ruled Thursday that Travelers Property Casualty Co. must help defend flavoring maker Kerry Inc. against nine "popcorn lung" lawsuits because the company acquired Travelers insurance policies after a merger.

Kerry bought St. Louis Flavors Corp. in 2002, and it has since racked up millions of dollars in defense costs in the underlying diacetyl exposure lawsuits filed against St. Louis Flavors in Ohio, Missouri, Illinois and Montana state courts by former employees of microwave popcorn and candy plants who say they...
