Law360, New York (May 17, 2004, 12:00 AM ET) -- Taking a leaf from 1-800- Contacts, L.L.Bean has filed lawsuits against four major retailers, including JC Penney and Nordstrom, that it says are using "pop-up" box advertising on L.L.Bean's web site, llbean.com.
The four complaints, each filed separately in Maine District Court, name Nordstrom, JC Penney, Atkins, and Gevalia as companies that are trading on the clothier and outdoor gear retailer's name through their use of "spyware" enabled pop-up ad technology.
