Law360, New York (June 22, 2010, 4:05 PM ET) -- The defense counsel for accused financial fraudster Kenneth Marsh has asked the court to undo its disqualification of one their associates, saying the government offered no real evidence that she participated in Marsh's alleged fraud.
The removal of Falk & Associates LLC's Kim Flotteron from Marsh's case touches on the constitutional right of a defendant to choose his own lawyer, the firm said in a motion filed Monday.
