Law360, New York (April 06, 2011, 6:20 PM ET) -- A New York federal judge threw out a putative class action Wednesday accusing Xerox Corp. of unlawfully terminating health benefits for thousands of retirees, ruling the retirees had no standing on some claims and were not timely enough with others.
Association of Retired Xerox Employees Inc. chairman Samuel Coriale's complaint also alleged injuries based on a plan in which the plaintiffs did not participate, Judge David G. Larimer of the U.S. District Court for the Western District of New York said.
