Law360, San Diego (July 26, 2011, 4:17 PM ET) -- The Second Circuit on Tuesday upheld the dismissal of TradeComet.com LLC’s antitrust case over the prices Google Inc. charged it to use the search engine advertising platform, citing Google’s forum selection clause requiring AdWords participants to file suit in California.
In a summary order, the three-judge panel determined a federal district court properly applied a test to determine that the suit brought by TradeComet, which operates the business-to-business search engine SourceTool.com, should be tossed due to Google’s clause.
