Law360, New York (March 28, 2012, 1:11 PM ET) -- As the controversy surrounding hydraulic fracturing (hydro-fracking) and natural gas drilling ensues, a New York court upheld a town’s zoning ordinance banning natural gas drilling.
Although a case of first impression, the Tompkins County New York Supreme Court relied on the jurisprudence from a comparable statute and held that New York’s Oil, Gas and Solution Mining Law (OGSML) does not prohibit a town from enacting zoning ordinances which prohibit oil and gas drilling in its boundaries.
