Starbucks Steamed Over 'Charbucks' Ruling, 2nd Circ. Hears

Law360, New York (May 08, 2012, 7:33 PM ET) -- Starbucks Corp. on Friday asked the Second Circuit to rule that a New Hampshire microroaster diluted the coffee giant's famous brand by marketing a dark blend called “Mister Charbucks,” saying the district court erred in finding for the mom-and-pop shop.

In a brief filed Friday, Starbucks said U.S. District Judge Laura Taylor Swain erroneously blended two distinct statutory factors of the Trademark Dilution Revision Act when she tossed the long-standing suit last December against Wolfe's Borough Coffee Inc.
