Exxon Tells 2nd Circ. $105M MTBE Verdict Premature

Law360, New York (May 23, 2012, 3:00 PM ET) -- Exxon Mobil Corp. urged the Second Circuit on Wednesday to throw out a $105 million jury verdict in multidistrict litigation alleging it contaminated New York City water wells with methyl tertiary-butyl ether, calling the pollution "speculative" because the wells are dormant.

Exxon asked a three-judge panel to reverse a September 2010 judgment finding that MTBE — an additive used to oxygenate gas in order to reduce air pollution — seeped from its tanks into water wells in Jamaica, Queens.
