REBUTTAL: A Distorted View Of Asbestos Litigation Reality

Law360, New York (June 4, 2015, 4:49 PM EDT) -- We write to respond to the hysterical, hyperbolic and factually incorrect article entitled, "It's Time To Fix NYC's Broken Asbestos Litigation System." This defense/insurance propaganda piece, from start to finish, is nothing more than an effort to plea to and influence the current "asbestos docket judge" (who undoubtedly will see this piece for what it is) and the court of public opinion in favor of the authors' agenda. When parties in litigation resort to these types of efforts, it is nothing more than proof of their lack of confidence in the merits of their legal arguments. Unfortunately, the defense piece denigrates the NYC asbestos judges who have done a herculean job over the last three decades working harder than any other judges in the country trying to expedite justice for all litigants....
