Burnett issued a gaming industry notice on Oct. 15, 2015, detailing his findings that daily fantasy sports constitute gambling under Nevada law, the primary focus of media stories related to the notice was that DFS could no longer be offered for play in Nevada. But Chairman Burnett's notice also stated that DFS can be offered in Nevada if the DFS operators obtain a license issued by the Nevada Gaming Commission to operate a sports pool and thereafter comply with all applicable laws and regulations governing licensed sports pools....
