Law360, New York (January 15, 2009, 12:00 AM ET) -- A down economy could be a boon to intellectual property litigators’ business as companies try to shore up their holdings, according to Darin Snyder, chair of O’Melveny & Myers LLP’s intellectual property and technology practice.
“Historically, companies often resort to enforcing intellectual property rights to protect market share in a declining economy. This is an aspect of IP litigation that is often countercyclical [to the market],” Snyder said.
IP litigation also tends to rise in a down economy because of decreases in employment stability.
