Law360, Los Angeles (August 11, 2011, 4:17 PM ET) -- JetBlue Airways Corp. told a California judge Thursday that a putative class action alleging the airline company violates state privacy law by secretly monitoring or recording customers' phone calls is preempted by federal aviation law.
JetBlue attorneys told California Superior Court Judge Kenneth R. Freeman that the suit is barred by provisions in the Airline Deregulation Act because the conversations covered in the suit specifically involve customer-service related work, including calls to arrange flight reservations and make ticket purchases.
