Media Consultant Sent Unsolicited Anti-Smoking Texts: Suit

Law360, New York (November 08, 2011, 7:44 PM ET) -- Media consultant PHD Media LLC was smacked with a class action in California on Tuesday alleging it sent unsolicited text messages to cellphone users on behalf of an anti-smoking group.

Illinois resident Jerome Damasco received a text message from PHD on behalf of the American Legacy Foundation about quitting smoking, but Damasco had never permitted PHD to send him texts, calling them an “especially misguided and pernicious form of marketing,” according to a complaint filed in federal court.
