Law360, New York (February 17, 2012, 4:55 PM ET) -- A Pennsylvania federal judge on Thursday tossed putative class claims in a suit alleging CUNA Mutual Insurance Society wrongfully denied or terminated credit disability benefits under its insurance policies, finding that collateral estoppel barred those claims.
Although U.S. District Judge Cathy Bissoon said CUNA could not escape the individual claims, she agreed to drop the class claims of breach of contract and bad faith after finding that a decision in a related suit barred the plaintiffs from suing as a class.
