11th Circ. Nixes Bid To Block $12M Enfamil False Ad MDL Deal

Law360, New York (July 23, 2012, 3:12 PM ET) -- The Eleventh Circuit on Friday rejected a challenge to Mead Johnson & Co.’s $12 million settlement with consumers in multidistrict litigation that accused the nutrition giant of falsely advertising its infant formula Enfamil as “clinically superior” to competitors.

A three-judge panel unanimously rejected appellant Sandra M. Pack’s objections to the terms of the settlement — including a provision that would donate unclaimed settlement funds to charity — upholding a district court ruling that noted  significant evidence of bad faith in her objection.
