State Farm Wants Out Of Suit Over Medical Biller's Faxes

Law360, New York (August 29, 2012, 2:41 PM ET) -- State Farm Fire & Casualty Co. on Monday asked a Missouri federal judge to find it has no duty to defend or indemnify Nationwide Medical Billing LLC in a proposed class action accusing the company of sending unwanted faxes.

Nationwide and its owner, Joseph Peter Cervera, were sued in April by St. Louis Heart Center Inc. over the faxes, which the Heart Center claims are a violation of the federal Telephone Consumer Protection Act. Cervera submitted a claim under his homeowners policy to State Farm, which agreed...
