Law360, New York (May 14, 2012, 3:49 PM ET) -- The U.S. Supreme Court declined to hear an appeal by private equity firm KKR & Co. LP and an Alabama-based supermarket owner Monday in a case brought by KKR noteholders who claimed the firm improperly acquired Bruno's Inc. in 1995.
The high court declined to take up the appeal brought by KKR and Bruno's, which claimed that the noteholders lacked standing to proceed in Alabama state court because the alleged misrepresentations to clients did not take place in Alabama.
