Law360, New York (January 05, 2010, 3:57 PM ET) -- A federal court has struck down a federal ban on color, graphics and certain language in tobacco labels in advertisements as unconstitutional, though he has upheld other parts of the Family Smoking Prevention and Tobacco Control Act.
Judge Joseph H. McKinley Jr. of the U.S. District Court for the Western District of Kentucky ruled Tuesday that parts of the law were overly broad and violated tobacco companies' First Amendment rights.
