US Appeals Katrina Canal Breach Defeat To 5th Circ.

Law360, New York (February 26, 2010, 3:17 PM ET) -- The U.S. government has appealed a landmark ruling that the U.S. Army Corps of Engineers' dredging of the Mississippi River Gulf Outlet caused a levee breach that drenched parts of New Orleans after Hurricane Katrina.

The federal government appealed to the U.S. Court of Appeals for the Fifth Circuit on Thursday, fighting Judge Stanwood R. Duval's ruling that the Army Corps neglected to maintain properly the Mississippi River Gulf Outlet and his award of $719,000 to five New Orleans residents.
