Travelers Wants Developer's $25M Coverage Suit Nixed

Law360, New York (March 10, 2010, 5:10 PM ET) -- Travelers Casualty and Surety Co. has asked a federal court to toss Del Webb Corp.'s lawsuit seeking millions of dollars in insurance coverage for fixing faulty construction, saying the case duplicates an action already pending in California state court.

The insurance company filed a motion Tuesday asking the U.S. District Court for the District of Nevada to dismiss the developer's suit based on the Colorado River abstention doctrine, accusing Del Webb of improper forum shopping.
