Dow, Vulcan Fail To Sink PCE Water Pollution Suit

Law360, New York (March 15, 2010, 3:37 PM ET) -- A federal judge has refused to dismiss a lawsuit accusing Dow Chemical Co. and Vulcan Materials Co. of contributing to water pollution in the U.S. Virgin Islands by failing to include the appropriate warnings on solvents containing hazardous materials.

Judge Curtis V. Gomez of the U.S. District Court of the Virgin Islands denied the companies' motion to entirely dismiss the three-count complaint Thursday, though he agreed to toss a private nuisance claim. Negligence and strict products liability claims remain.
