2nd Circ. Seeks Input On Time Bars In Ephedra Case

Law360, New York (March 17, 2010, 6:00 PM ET) -- A federal appeals court asked a New York state court on Wednesday to help determine if state law time-bars a lawsuit that alleged ephedra, a dietary supplement, caused a man's aneurysm and subsequent strokes.

The U.S. Court of Appeals for the Second Circuit is asking the New York Court of Appeals to determine whether a one-year extension to the state's statute of limitations is limited to cases where an injury is caused by a "latent" effect of a drug.
