MDL Panel Won't Centralize Pain Pump Suits

Law360, New York (April 19, 2010, 1:52 PM ET) -- The U.S. Judicial Panel on Multidistrict Litigation has declined to centralize more than 100 lawsuits against companies including Stryker Corp. and Abbott Laboratories brought by plaintiffs who allegedly developed a degenerative condition after using a pain pump.

The panel ruled Wednesday that centralization would neither serve the convenience of the parties nor promote the just and efficient conduct of the litigation, finding that there were too many individualized issues at stake in the 102 cases the plaintiffs sought to consolidate.
