Law360, New York (May 25, 2010, 5:09 PM ET) -- The lead plaintiff in a putative class action accusing Sears Roebuck and Co. of deliberately selling faulty garage door openers has asked a federal court to reverse a previous order and force Sears representatives to testify at a deposition.
Sears' testimony is necessary to prove the class' unjust enrichment claims, lead plaintiff Melanie Rait said in a motion to reconsider filed Monday in the U.S. District Court for the District of New Jersey.
