Suit Over Diacetyl In ConAgra Popcorn Stays Alive

Law360, New York (July 01, 2010, 5:47 PM ET) -- A judge has refused to dismiss a proposed class action accusing ConAgra Foods Inc. of continuing to use the butter-flavoring chemical diacetyl in its microwave popcorn products, despite making claims to the contrary amid health concerns.

Judge S. James Otero said Tuesday that plaintiff Courtney Fine had established that there was a case or controversy, so the lawsuit can proceed in the U.S. District Court for the Central District of California.
