Allergan Board Must Pay For $600M DOJ Deal, Suit Says

Law360, New York (September 07, 2010, 2:15 PM ET) -- An Allergan Inc. shareholder has sued to force members of the company's board to shoulder the burden of a $600 million settlement with the U.S. Department of Justice over off-label uses of its lucrative Botox drug.

The Louisiana Municipal Police Employees Retirement System brought the stockholder derivative complaint Friday in Delaware Chancery Court, claiming that members of Allergan's board of directors should pay for the DOJ settlement because they'd breached their fiduciary duties by allowing the violations that led to the settlement.
