Law360, New York (January 18, 2011, 6:57 PM ET) -- The U.S. Supreme Court questioned both sides on the issue of class certification during oral arguments Tuesday in a putative class action alleging Bayer Corp. failed to warn that its recalled cholesterol drug Baycol could have fatal side effects.
The case could have a significant impact on class actions, attorneys said, because the Supreme Court must decide whether a ruling denying class certification in one case could prevent another plaintiff from bringing a similar class action if unaware of the previous suit.
