Paxil Suits Remanded To State Court, To GSK's Chagrin

Law360, New York (March 30, 2011, 4:04 PM ET) -- A federal judge last week remanded to Pennsylvania state court eight suits alleging Paxil caused birth defects, in a ruling that may make it harder for GlaxoSmithKline PLC to litigate future claims in federal court, its preferred venue.

Judge Timothy J. Savage of the U.S. District Court for the Eastern District of Pennsylvania issued the ruling March 24, finding that GSK, despite being a Delaware limited liability company, is principally based in Philadelphia, allowing the plaintiffs to pursue their cases in state court there.
