Lilly Suffers Setback In Zyprexa Suit

Law360, New York (July 02, 2007, 12:00 AM ET) -- The judge overseeing the multidistrict litigation involving controversial antipsychotic drug Zyprexa has shot down Eli Lilly's request for summary judgment, ruling that a set of plaintiffs has a right to pursue its fraud and overpricing claims against the pharmaceutical giant.

On Thursday, Senior U.S. District Judge Jack Weinstein sided against Lilly in a portion of the chaotic litigation, ruling that the group of direct purchasers should be allowed to proceed with their overpayment complaint.
