Law360, New York (November 29, 2011, 6:44 PM ET) -- The U.S. Food and Drug Administration on Tuesday appealed a federal judge's ruling blocking graphic warnings on cigarette packages on the basis that R.J. Reynolds Tobacco Co. and others were likely to win a First Amendment challenge to the labels.
The FDA asked the D.C. Circuit to review a Washington federal court's injunction against the rollout of the new cigarette warning labels.
