Law360, New York (July 13, 2007, 12:00 AM ET) -- As the scrap over Medtronic Inc.'s allegedly faulty defibrillators gears up for trial, the fate of the company's preemption defense could hinge upon how the judge perceives the relationship between state and federal laws.
So far the outlook isn't pretty for Medtronic. In the last month, it has seen the Supreme Court accept a preemption case over its coronary catheters and a district court shoot down a preemption defense Guidant Corp. gave of its own defibrillators.
