Law360, New York (January 31, 2012, 5:22 PM ET) -- A New York federal judge on Monday tossed multidistrict litigation accusing Hospira Inc., Sandoz Inc. and three others of failing to warn consumers about the risks associated with generic versions of cancer treatment Aredia, citing the U.S. Supreme Court's decision in Pliva Inc. v. Mensing.
U.S. District Judge Kiyo A. Matsumoto found that the remaining nine plaintiffs' state-law tort claims, which stemmed from the patients' development of osteonecrosis of the jaw after taking pamidronate, were preempted by federal regulations applicable to generic drugs.
