Costco Says Wash. Law Applies In Cheese Coverage Suit

Law360, New York (February 03, 2012, 9:17 PM ET) -- Costco Wholesale Corp. asked a federal court in Washington state on Thursday to rule that Washington law applies in its suit seeking at least $20 million in damages from Nationwide Mutual Insurance Co. for denying coverage related to allegedly contaminated cheese.

“Nationwide has conceded in its answer that Washington law governed its duties to Costco. The lawsuit concerning Nationwide's discharge of its duties is therefore also governed by Washington law,” Costco said in a motion for partial summary judgment.
