Liberty Ducks $13M Bad-Faith Punitive Damages Award

Law360, New York (August 13, 2012, 5:06 PM ET) -- A South Carolina federal judge on Friday overturned a jury's bad-faith finding and freed Liberty Mutual Fire Insurance Co. from paying a $12.5 million punitive damages award to two policyholders in a fight stemming from settlements of homeowner suits over allegedly defective windows.

Granting part of Liberty's motion for judgment as a matter of law, U.S. District Judge Margaret Seymour remarked that she was not aware of any other South Carolina case where an insurer was held liable for bad faith while settling a policyholder's case...
