Dole Escapes Banana Workers' Pesticide Suits In Del.

Law360, Wilmington (August 21, 2012, 6:19 PM ET) -- A Delaware federal judge on Tuesday dismissed Dole Food Co. Inc. and four others from suits claiming the companies exposed banana plantation workers to the harmful pesticide DBCP, ruling the duplicative suits should be decided in the district where they were first brought.

The six suits filed June 1 were identical to those entered by the same plaintiffs in Louisiana federal court exactly one year earlier, the defendants said, and should be dismissed by the Delaware court on the basis of the “first-filed” rule, which gives...
