Law360, New York (September 20, 2012, 7:51 PM ET) -- Contracting firm KBR Inc. must face allegations that Oregon National Guard members exposed to toxic chemical agents at one of its Iraqi sites suffered emotional distress, a federal judge held Wednesday in a class action against the Halliburton Co. subsidiary.
U.S. Magistrate Judge Paul Papak threw out the guardsmen's medical damages claims, but held that KBR may have violated its contractual duty to protect the guardsmen against environmental hazards and consequently must answer to their emotional distress claims.
