Continental Needn't Cover Boat Co. In Carbon Monoxide Suit

Law360, New York (October 16, 2012, 8:30 PM ET) -- A Florida federal judge on Thursday said Continental Insurance Co. has no duty to defend boatmaker Marlow Marine Sales in litigation over workers' alleged injuries from carbon monoxide exposure, saying the insurer did not receive timely notification of a claim.

Marlow was sued in February 2007 by two seamen who worked aboard a boat built by the company and alleged they were exposed to excessive amounts of carbon monoxide that caused them personal injuries and damages. The company submitted a claim to Continental in March 2007,...
