Walgreen Says Insurer Owes It $3M For Avastin Defense

Law360, New York (October 17, 2012, 1:33 PM ET) -- Walgreen Co. urged a Florida federal judge Tuesday to declare that its policy with Western Heritage Insurance Co. provides $3 million to defend the pharmacy chain against a dozen eye injury lawsuits over its sale of Genentech Inc.'s cancer drug Avastin.

Western Heritage sued Walgreen, InfuPharma LLC and others earlier this year, claiming it does not have to defend the pharmacies because allegations in the underlying suits that the companies improperly compounded, manufactured or sold the drug constitute a failure to render professional services, which triggers...
