TJX Fights Transfer Of Class Action To State Court

Law360, New York (February 11, 2008, 12:00 AM ET) -- In litigation stemming from what has been called the largest retail security breach in U.S. history, discount retailer TJX Cos. has made another strategic move in its ongoing battle to keep the case in federal court.

Ever since a federal judge in December transferred the remaining claims from the multidistrict litigation to Massachusetts Superior Court, TJX has been fighting to allow the case to stay put, appealing the transfer order and asking an appeals court to stay the transfer pending a ruling.
