Law360, New York (July 09, 2008, 12:00 AM ET) -- A district judge has refused to dismiss the Commonwealth of Puerto Rico's lawsuit against units of Chevron Corp., Citgo Petroleum Corp., Exxon Mobil Corp. and other oil companies accused of creating environmental havoc through their use of MTBE.
The defendants, involved in a widespread multidistrict litigation over methyl tertiary-butyl ether, argued that as a component of the gasoline they refined or manufactured, the MTBE they discharged was protected under the Comprehensive Environmental Response, Compensation and Liability Act's petroleum exclusion.
