Judge Hangs Up On Cell Phone Hazard Suit

Law360, New York (September 08, 2008, 12:00 AM ET) -- A federal judge has thrown out a putative class action accusing a spate of cellular phone manufacturers of participating in a conspiracy to market cell phones while suppressing knowledge of the adverse biological effects and health risks allegedly posed by radio frequency emissions.

The Sept. 2 ruling by Judge John R. Padova of the U.S. District Court for the Eastern District of Pennsylvania held that the state law claims contained in plaintiff Francis Farina's third amended complaint were preempted by federal law.
