2nd Circ. Spurns Thai Appeal Of $37M Toll Project Award

Law360, New York (August 09, 2012, 9:54 PM ET) -- The Second Circuit on Wednesday refused to “second-guess” a Thai arbitration panel that in 2009 awarded a German contractor €30 million ($37 million) after finding the Thai government had interfered with the contractor's ability to collect revenue from a toll road project.

A three-judge panel determined the Southern District of New York hadn't erred last year when it enforced the arbitration award, over Thailand's objections that now-bankrupt construction firm Walter Bau AG was missing a critical project certificate.
