Law360, New York (August 28, 2012, 6:07 PM ET) -- A North Dakota federal judge on Monday allowed the state’s Public Service Commission to intervene in a suit brought by environmental groups seeking to rescind the state’s authority to regulate surface coal mining, ruling the PSC was unconditionally allowed to intervene by law.
Magistrate Judge Charles S. Miller Jr. granted the PSC’s motion to intervene without restrictions or conditions, despite the request of plaintiffs the Dacotah Chapter of the Sierra Club and Dakota Resource Council to limit the issues the commission could raise in the case....
