USCIS 'Public Charge' Reg Would Add More Sand In Gears

By Jeffrey Gorsky (October 22, 2018, 2:12 PM EDT) -- The notice of proposed rule-making by U.S. Citizenship and Immigration Services that expands the definition of public benefits in determining visa ineligibility on "public charge" grounds, has principally been criticized for its detrimental impact on immigrant visa applications. But another provision of the rule that has not received much public attention would require public charge investigations in routine nonimmigrant applications for change of status, or COS, and extensions of stay, or EOS. This provision is based on questionable legal authority and will mainly serve to further slow an already overstressed system....
