CIT Blasts ITC Decision To Keep Ball Bearing Duties

Law360, New York (September 01, 2009, 6:56 PM ET) -- The U.S. Court of International Trade has again remanded a decision by the U.S. International Trade Commission that revoking anti-dumping duty orders on imported ball bearings would injure the domestic industry, saying the finding is unsupported by substantial evidence.

Judge Judith M. Barzilay of the CIT ruled Monday that the ITC determination failed to take into account whether the bearings subject to the duties were more than a tangential cause of injury to domestic industry, as many low-priced bearings not subject to the duties are available...
