USPTO Revises Appeal Briefs Procedure

Law360, New York (April 01, 2010, 7:28 PM ET) -- The U.S. Patent and Trademark Office has changed its procedure for reviewing appeal briefs filed in patent applications, shifting the responsibility to the chief judge of the Board of Patent Appeals and Interferences.

The change was announced in a Federal Register notice Tuesday and went into effect immediately.

Under the new procedure, the Patent Appeal Center and the examiner will no longer review appeal briefs to determine whether they are in compliance with applicable regulations. That task will now fall solely to the patent appeals board...
